Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Voice Nimble application (the "App") for Shopify. By installing or using the App you ("Merchant", "you") agree to these Terms. If you do not agree, do not use the App.

1. The service

Voice Nimble provides an AI-powered voice agent that places and answers phone calls on your behalf, including features such as call transcripts, optional call recording to your own cloud storage, order-related and broadcast calls, and related analytics. We may add, change, or remove features over time.

You must have an active Shopify store and the authority to bind your business to these Terms. You are responsible for the configuration of your agent, phone connections, and any content or instructions you provide to the App.

You are solely responsible for ensuring that your use of calling and call-recording features complies with all laws applicable to you and the people you call, including obtaining any required consent and providing any required notice. You are responsible for the phone numbers you call and the content of your campaigns and greetings.

6. Your data & storage

Our handling of personal data is described in our Privacy Policy. If you connect your own cloud storage bucket for recordings, you are responsible for that bucket, its credentials, and its costs, and you grant us permission to write recordings to it on your behalf.

7. Third-party services

The App relies on third-party providers (including Shopify, telephony, speech, and AI providers) to function. We are not responsible for those providers' availability or acts, and their use may be subject to their own terms.

8. Service availability

We aim to keep the App available but do not guarantee uninterrupted or error-free operation. We may suspend the App for maintenance, security, or to comply with law.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-generated responses may contain errors and should not be relied upon as professional advice.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOICE NIMBLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE APP IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You will indemnify and hold Voice Nimble harmless from claims arising out of your use of the App, your content, the calls you place, or your violation of these Terms or applicable law.

12. Termination

You may stop using the App and uninstall it at any time. We may suspend or terminate access for violation of these Terms or applicable law. On uninstall, data is handled as described in the Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
